LOSAP Question

I am a volunteer in Rockland County.

My department's LOSAP program currently consist of $20.00 per year, not to exceed $600.00 at time to collect, which is at

age 65.

Is this pretty consistant with other departments?

My dept is $20 per year, collect at 65, and max out at $800. In my area, they are all about the same. The real question is what does your dept do for those OVER 65 who still make their points?

We are $20 per year, $800 Max with members starting to collect at 60. Members over 60 who have not reached the max of $800 can increase their monthly payment by $20 the next year if they obtain the required 50 points the previous year.

Still have to be allowed to accrue points. There have been several court cases where those who reached 65 were told they could not accrue points anymore which is not the case

In my FD, a number of years ago we had a voter referendum that raised it to $30/year. That same vote also allowed folks to continue to accrue after age 65. Prior to that it was $20/year and no accrual after 65. So for folks who were members before, the have some $20 dollar/month years and now are accruing $30/month years.

You don't need a vote to be allowed to keep accruing after 65. It's Federal EEOC law. If a dept does not allow accrual over 65, that's age discrimination, and there are several cases in NY that have been won (and none lost) that tell disticts to "pay up". My districts lawyer has said that these cases wont be lost, and any district that wants to fight it will A) loose the case B) be made to pay the accrual difference c) be made to pay the lawyer fees.. Bottom line, don't fight it as your going to loose and have to pay the lawyer to fight the case your going to loose.
