Determination of Public Need

PLEASE TAKE NOTICE:

The Transportation Committee of the Hudson Valley Regional EMS Council in accordance with Public Health Law, Article 30 of the State of New York is conducting a Public Hearing with respect to the determination of a Public Need for an expansion of primary operating territory to include a portion of the Town of Hamptonburgh described as:

Route 208 North from the Blooming Grove Town line up to 3674 Route 208 and all roads intersecting; Route 207 from the New Windsor Town line to Hamptonburgh Road on the South side of the road, and to Maybrook Road on the North side of the road, including all roads intersecting Route 207 in this area; Sarah Wells Trail from Route 208 to Hamptonburgh Road, and all roads intersecting; Hamptonburgh Road from Route 207 to the Hamptonburgh/Goshen Town line, and all roads intersecting to the East of Hamptonburgh Road.

Public Need is defined as:

The demonstrated absence, reduced availability or an inadequate level of care in ambulance or emergency medical service available to a geographical area which is not readily correctable through the relocation or improvement of existing resources.

This service is located in Orange County, Town of Blooming Grove, with a primary operating territory of the Town of Blooming Grove.

The Public Hearing will be held on Tuesday, November 23rd, 2010 from 1PM to 3PM at the Hudson Valley Regional EMS office located at 45 Academy Avenue, Cornwall on Hudson, NY 12520. Speakers must sign in no later than 1:15PM. The hearing will continue until 3:00PM or all speakers are heard, whichever is earlier.

A copy of the application is available for review at the Hudson Valley Regional EMS Council office. If you wish to review it, please contact the Hudson Valley Regional EMS office at (845) 534-2430 to schedule an appointment.

Hamptonburgh does not have its own VAC. They, I believe, are currently served by Mobile Life Support Services.

Actually, if I read this correctly, this is just a formal expression of what already exists. Many years ago, the Town of Hamptonburgh was split up for BLS service between GOVAC, BGVAC, Town of Montgomery, and I believe a small portion to NWVAC because they had no ambulance. ALS was provided by whomever the ALS provider was for the volunteer agency and when BGVAC went ALS, they served this area with ALS and BLS coverage just as they had prior with BLS.

NYS DOH has asked all agencies & all REMSCO's to make sure the actual coverage area is listed on the CON. Many agencies have traditionally covered areas that are not listed in there CON.

In Westchester this was done for at least 4 agencies. For example one VAC's CON said it covers the town & village of X. But for the last 40+ years it actually covered the school district, whose area does not match the town/village border.

The reason for this is if you bill for service outside you CON (and not on mutual aid call) you may be comitting medicaid/medicare fraud (by definition).
