Isiah Thomas And HIPAA

It does not appear any HIPAA regulations were violated. HIPAA applies to those providing medical care. Every source of "facts" in the article appears to be the police department spokesman or taken from the open airwaves of PD dispatch. The only medical source mentioned in the article was the hospital, and it declined to give any pertinent facts, therefore not breaking HIPPA. While it may be in bad taste, the PD, through their investigation, can release information covered under HIPAA.

hipaa has to do with insurance information...hence the name health insurance portability and accountability act :unsure:

There's much more than Insurance portability. Release of patient information (PHI) by medical entities would violate patient privacy rule which falls under the accountability segment of Title II

True but the source of this information is not a medical entity so there is probably no foul (pun intended).

This does point out the vulnerability of our communications but that's for another thread!

HIPAA, unfortunately, applies only to those directly providing the patient care (and are, therefore, directly protecting the patient's privacy). So any POS who listens to a police scanner, gets patient info that way (via a "technically" public, rather than private or in-house source) and then DISSEMINATES that information is technically exempt from the HIPAA constraints. Therein lies the LOHUD rub and controversy- they stayed within that very gray but very inapproriate privacy-not-respecting area by naming Mr. Thomas as the O.D. patient (though that still has not even been confirmed, 2 days post). <_<

The 911 call and the Police Report are both public record. Any one of us can go to Harrison and use a FOIL to request such and report to the public on it. However, time spent in an ambulance or emergency room is nobody's business but your own. A few years ago a number of people at Columbia-Presbyterian hospital learned this when they were terminated for accessing David Letterman's medical records while he was in the Hospital for heart surgery. As well, Isaiah Thomas is a moron, if you are going to really hurt yourself, you don't OD on Lunesta!

At least there is someone else with sense.....WHO GIVES A **** ABOUT HIM ANYMORE????? I can blame him and the Dolans for the next increase in Cablevision rates.
