Question About Taxes On Workers Comp

I can't seem to get a straight answer anywhere, and my accountant is away for two weeks and my employer refuses to respond. It's impossible to decode the NYS and IRS websites. So I figured someone here may be able to help me in laymans terms.

I'm trying to budget for 2008, and am trying to project how much of a refund I will get.

I am a career firefighter, and was injured while on duty. I have been out for almost a year now, and recieving my base salary, with taxes taken out.

Is Workers Comp salary taxable? Will all the taxes taken out be refunded to me? Someone somewhere along the line mentioned I shouldn't have taxes taken out on Workers Comp...just wondering if there was any truth to that?

Workmens Comp is supposed to be Tax Free, but if you are getting the full salary you should be able to get it all back, We have a WC Lawyer that spoke to our Union Group I have his card you may want and need to talk with Him.

I am hoping for a large refund so I can pay off the medical expenses that Worker's Comp or my department didn't cover (like copays, etc), and other debt I incurred from being unable to work, and making thousands less then I projected at this time last year.

From my understanding you should be covered under 207c, I believe its for Police and Fire. While out its tax free money and non taxable income. So if you were out a whole year you have 0! And as far as "other expenses" I believe WC is supposed to cover that too, that includes copays and all. You should also get mileage to and from Dr. appt, PT etc. I would get in touch with a lawyer who specifically does WC cases.

207-c is for law enforcement and 207-A is for firefighters. Both I believe have similiar benefits. If you are on workmans comp you are not on either 207-c or 207-a and your income is taxable. I went through it with my broken ankle. Allthough I was hurt on the job it wasnt considered line of duty but on duty so I was only entitled to workmans comp but fortunately our labor contract states my employer has to make up the difference. I would check your labor agreement and also contact a lawyer that specializes in this issue.

Seth if you were hurt while you were working why are they giving you such a hard time paying your bills? You will get all of those taxes that you paid in your checks back. You do have to go to the COMPTROLLER and talk to them though. They should be able to help you.
