(Original publication: July 23, 2007)

WHITE PLAINS - Police are searching for a man who stole a car from a gas station this morning.

The car, a silver 1999 Acura, was left running and unattended while its driver was in the Sunoco Mini Mart at 395 Central Ave., police said.

The thief drove off around 6:30 a.m.

The incident prompted White Plains police Lt. Joe Castelli to remind drivers that it is illegal to leave vehicles running while unattended.

"That might help us cut down on these kinds of crime," he said, referring to this morning's theft. "It doesn't happen often, but when it does, it's just something that's preventable."

The description of the thief was sketchy.

Anyone with information about this crime can call White Plains police at 914-422-6111.

I personally feel that the idiot that leaves their car running unattended sort of deserves this. This is not the 1920's!!!!! People are not honest, in case you didn't know! How about ticketing the person for idling unoccupied auto, since as Lt. Castelli states, it is illegal!!!!!...Also does insurance cover this, when people are plain stupid?

I am off today and don't have my own VTL book, what is the section if anyone knows...

Being stupid and violating the law by leaving the car running does not change the fact that it was stolen so insurance will, most likely, cover it.

If insurance companies didn't have to pay claims for incidents brought about by stupidity, they'd never have to pay for anything!!!

True, but can this qualify as fraud? Like, say I have a beat up car and need to get rid of it so I leave it running on Elliott Av in Yonkers and then report it stolen...although they may not know my intentions, they may hang me no? HYPOTHETICAL!

Alright, maybe that is a little different than the case at hand, but couldn't they say to the person prove that you didn't leave the keys in the car on purpose to get rid of it...I guess I am just annoyed that because of incidents such as this I pay insurance costs that I feel are unreasonable and am sure that all NYers are with me on that, especially those on this site!

insurance case law describes leaving the keys in the car/ignition equals implied permissive use and the insurance will cover it.

Oswego,

Here in the lovely land of the fruits and nuts, we've had a rash of these types of GTAs (Grand Theft Auto), where it's a mother who leaves her child in the car while she runs into a building (store, parent's house, etc). Then when the car is stolen an Amber Alert goes out for the child. Generally, law enforcement finds the car. But they have never in any of these cases charged the parent with child endangerment for leaving them alone in the running car. Bunch of hand holding kumbayah singing touchy feely nuts that don't understand the importance of being a parent. Who's mas stupido???
