Flagpeople: What Authority Do They Have?

31 posts in this topic

Why would I ask an NYPD Sergeant? Are NYPD Sergeants privy to special knowledge the rest of us aren't? Once again, people continue to argue that this myth is true, but have provided zero proof. On the other hand, I have linked to both the NYS V&T laws as well as the NYS Driver's Manual, neither of which support any claim that a USPS vehicle has any right of way above and beyond the normal rules of the road, and certainly not above and beyond that of an authorized emergency vehicle engaged in an emergency response.

This is directly from the USPS themselves:

So again, find me any federal, state, county, city, town or village law that supports the argument that USPS vehicles have any priority right of way to support the myth many of you insist on propagating. Until someone can, all you're doing is repeating over and over again something that may have been true decades ago, but is no longer.

The highest law of the land is the U.S. Constitution. If something is prohibited in the Constitution, it's "unconstitutional" which is about as illegal (or "unlawful" as those in the know prefer to say") as it can get. If a law, ANY law, conflicts with the Constitution, the Constitution wins, hands down. An amusing corollary of that comes from the fact that the Postal Service is written into the constitution. It's unconstitutional to impede a postal carrier. Q. Who has to yield right of way at an intersection, a fire truck with lights and siren, an ambulance with lights and siren, a police vehicle with lights and siren, the Presidential motorcade, or a post office truck? A. Everyone has to yield right-of-way to the postal truck.

It is also the the US Post office procudere to follow the law of the state. The same way it is or at least was that emergency personal are not requried to wear seatbelts, it it the agencies that we work for sets them in there procdures. So in reality you are not going to have a mail truck run a red light or not yeld to emergency personal, but as you read above that are allow to by law.
