Similar in NY, even if your later found not-guilty of the criminal charges: Chemical Test Refusal- $500 civil penalty ($550 for commercial drivers) Lic Revoked for at least one year, 18 months for commercial drivers. Chemical Test Refusal within five years of a previous DWI-related charge/Chemical Test Refusal- $750 civil penalty Lic Revoked for at least 18 months, one-year or until age 21 for drivers under age 21, permanent CDL revocation for commercial drivers. Chemical Test Refusal - Zero Tolerance Law $300 civil penalty and $50 re-application fee Lic Revoked for at least one year. In this scenario, I would not issue a UTT for Cell Phone Use (1225-c) based solely on the second parties word. If it were a fatality or Serious PI, you could take the phone into evidence, and after securing a search warrant, check the call log. The Courts have recently held that absent the search warrant, you cannot start looking thru it, solely incident to arrest.

I never had any difficulty articulating it in Court. Maybe V-2 was initially 500 feet behind, but at some point (immediately preceding impact) they were in fact following too closely. The VTL does not state that the offending vehicle needs to be following to close for a predetermined period of time or distance. Let the operator attempt to offer an affirmative defense of "I wasn't paying attention". Local judges I work with won't let that fly.

When I was on the road I wrote 'Following Too Close', VTL 1129A, all the time. If you weren't following too close, you'd have enough time to stop.

That's right. That was the original criteria, 25 NM radius. It may have changed, I've been out of the game for a bit now, but that was the Auto-Launch criteria, pre-LifeNet.

NYSP (Statewide, not just Cortlandt) ride 2 to a car from 11p-7a. WCPD provides one patrol (single man) 8a-4p and 4p-12mid.

Many upstate rural counties, there is one Trooper PER COUNTY. Back up can be 20-45 minutes away. That's a fact.

NYSP does require this. The night tour runs 7pm-7am. Troopers double up in one car at 11PM for the remainder of the night. (The contract requires only 12mid-5am, but guys generally do 11p-7a).
