I'm fairly sure we had this very discussion at some point over the past few years. Legally speaking, they can possess and use RLS. The manner in which they use them, in terms of due regards for other motorists, well, that's a different story. (Believe me, I know, I live 10 minutes from KJ.)

Well, given some responses on quasi-related posts, it doesn't really matter. If a department says they "need" it, then they "need" it, right? Doesn't matter what unbiased, independant observers say, does it?

So, run with me on this. If EVERY agency in Southern Dutchess County wanted (6) Engines, (3) Ladders, (2) Heavy Rescues, (3) Tankers, etc., is that fine? That would make for some absurd number of apparatus in the region. Dozens and dozens of units, many of which cannot be staffed during the day (or in some cases even at night.) Think of what you could do with the savings? It would be millions of dollars.

This is nice to see, there should be more of it. Now, and I can't discern from the article, were these guys hired solely due to their veterans status, or it was a coincidence that the top 49 guys on the list happened to be veterans? Either way, nice work on behalf of the city.

You (or more appropriately your bargaining unit) can pursue an Article 78 Proceeding to file for Certiorari if you believe you have a valid minimum staffing case, but you failed to obtain relief at the administrative level. Correct, that's what I said originally. As has been addressed in previous threads, in which I have provide relevant case law and citations which you can search, generally not. You using common sense and I agree with you. That however, is independent of having a cause of action to file suit seeking civil relief. And the above is my opinion, but also supported by case law and legal precedent. I might not agree with it, but it is what we must abide by legally.

Industry standard is typically not a cause for action. Rather, collective bargaining agreements are the proper avenue, at which point a PERB or similar complaint can be made, or if need be an Article 78 hearing. If CBA's don't dictate staffing, there is no such thing as "minimum" in the legal sense. Rather, the "minimum" is whatever the city says it is.

Actually, I might go one step further and say certain aspects of Yonkers finances are already under de facto control. http://polhudson.lohudblogs.com/2012/07/02/state-comptroller-oks-revised-yonkers-budget/ It's not a financial control board, but it's hard to argue that Yonkers is free to make completely independent decisions.

Second link works for me. The fact that the first link is from last year is actually pertinent. Generally, municipal bodies that come under the domain of financial control boards do not do so after a single year. So that fact that it's been under discussion for over one year (at least two in Yonkers' case) is an important element. In practicality, it does not change the fact that there has been discussions of it, whether you agree or not.
